Abstract

Many law graduates complete their LLB with strong doctrinal knowledge yet little practical guidance on how to produce original legal scholarship. This gap becomes particularly significant for graduates seeking judicial clerkships at the Constitutional Court of South Africa, where applicants are expected to demonstrate the capacity to identify legal problems, construct rigorous arguments, and engage critically with constitutional jurisprudence.

This guide provides a structured introduction to the craft of legal research and writing for aspiring constitutional scholars. It explains how to identify a research problem, formulate a defensible thesis, frame research questions, engage with existing literature, and construct a well-structured legal argument. The guide also situates research within the institutional context of the Constitutional Court, outlining the kinds of analytical skills and scholarly engagement expected from prospective clerks.

Although designed primarily for South African LLB graduates applying for Constitutional Court clerkships, the guide offers broader methodological insights into constitutional law scholarship and legal research writing.
